How to register Patent in India 2016?

Procedure to file a patent for your idea or startup product in India.Following are the things on which you are allowed to take a patent or file a patent. Before thinking to take patent in India, understand whether your are eligible for that or not?

Art, Process, Method or Manner of manufacture;
Machine, Apparatus or other Articles;
Substances produced by Manufacturing
Computer Software which has Technical application to Industry or is used with Hardware
Product Patent for Food / Chemical / Medicines or Drugs

Requirements for filing a Patent registration:

You should provide the following details along with other data which are necessary
Basic Personal Details: Full name, address & nationality of applicant (s) and inventor (s).
Product details: Specification , provisional / complete drawings , claims and abstract.
List of countries to claim priority , if any, where the application / applications for the grant of patent has / have been filed , alongwith date and application number.

What is the procedure after submitting documents?


  1. Your request will be processed. You will be asked to attend for examination. This  is generally performed to know whethen you are the actual person who filed the patent.
  2. After examining by Patent office of India, if they have or need any clarifications will be raised. You are supposed to clarify them.
  3. After removal of all the objections, the Patent is granted and is advertised for Opposition Purposes.
  4. The patent is then allowed for any third party oppositions upto one year.
The renewal period for PATENT is one year.
